The Equal Employment Opportunity Commission (EEOC) is suing AT&T Inc. (T) for age discrimination.

The agency says AT&T refuses to re-hire workers who have retired. (Guess Ed Whitacre’s out of luck if his GM gig doesn’t work out.) EEOC lawyers say AT&T’s policy not only is illegal but also hurts the telecom giant by blocking former employees with experience.

AT&T has not addressed the allegations in public but did tell news outlets in a prepared statement that “discrimination of any sort … is not tolerated.”

Sure, OK. So the whole exclusive iPhone deal isn’t discrimination?
